Regulations on correction of trademark registration errors in Vietnam
The regulations on trademark registration fees in Vietnam allow for periodic adjustments to support economic policies. Fee reductions are reviewed annually based on the country’s socio-economic policies. For instance, in 2021 and 2023, the Minister of Finance issued Circular No. 47/2021/TT-BTC and Circular No. 44/2023/TT-BTC, which reduced industrial property fees and application fees for trademark registration by 50% from the rates specified in Section A of the Fee Schedule attached to Circular No. 263/2016/TT-BTC, aiming to help the market economy recover after the COVID-19 pandemic.
In October 2023, the Minister of Finance issued Circular No. 63/2023/TT-BTC, amending and supplementing some provisions on fees to encourage the use of online public services. This included a 50% reduction in industrial property fees under Circular No. 263/2016/TT-BTC, effective from January 1, 2024, to December 31, 2025.
However, it’s important to note that as of December 2023, the online public service portal of the Intellectual Property Office of Vietnam will only support online patent applications starting in January 2024. This means that from January 2024 onwards, the fee reduction will only apply to online patent protection applications and not yet to trademark registrations until further notice is announced on the online service portal.
